July 20, 2005Eminent-Domain Bill Runs Into TroubleBy John PruettTuesday might have spelled trouble for the House's revision of SB 62. The bill, authored by Sen. Kyle Janek (R-Houston), came in response to the Supreme Court's June decision on municipal use of eminent domain. On Sunday, the House passed the extensively amended Senate bill. However, yesterday Rep. Frank Corte, Jr. (R-San Antonio) led the charge in a 91-40 vote to block sending SB 62 to Conference Committee after fears that the bill's language would be watered down. This means the bill returns to the Senate. Channel 8 in Dallas reports: Further down:
It's not readily apparent what the Senate's decision means for an amendment authored by Rep. Rene Oliveira (D-Brownsville) that would prohibit "lodging facilities" from being included under eminent domain for "economic development." Oliveira's cousin Carlos owns the restaurant Players, which has been embroiled in a dispute with the UT System over the construction of a conference center and hotel. It appears that the Senate didn't want to take some of the other amendments the House had put on, and would have accepted Rep. Oliveira's amendment. However, since the Senate probably won't take the bill up for consideration, it's all a moot point. Of course, that may be the best, since the University is claiming they would have been able to seize Player's anyways...is there anyone who is for this hotel? Oliveira's amendment gets passed ASAP. The next regular session is too far away, and UT would have plenty of time to act given that window of opportunity. It seems to me that the legislation could still be brought up if Perry decides to call another special session. Even then, I don't know how good the odds would be w/ the Senate, but it seems ridiculous to drop the entire issue because of chamber differences. However, I will agree that the eminent-domain issue was most surely taken on in an attempt to build political capital for next year's elections. Posted by: John Pruett at July 20, 2005 05:06 PM
